with your purchase, we will take it back within 14 days of purchase. If
you are in doubt of which robot is best for you, all we ask is that you
either call us or send an e-mail with your question prior to your purchase.
This will avoid a situation where you might not be happy with your purchase
due to the fact that the chosen robot will not work in your situation.
To date, we have had only a few customers return an item. We credit our
honest representation of our product line for this, as well as our customers
willingness to communicate with us prior to purchasing. So there it is,
a plain and simple guarantee. All you need to do is contact us prior to
your purchase regarding any questions or concerns not covered on our website.
Due to the fact that we cannot control who reads the supplied information
(and the fact that we incur a financial loss with returned products) all
returns will be refunded the purchase price minus 15% (restock
fee) and minus freight. Please read the information supplied on
the site or take a moment to contact one of our representatives if you

THE CUSTOMER AGREES TO BE BOUND BY THIS SALE AGREEMENT
AND ACCEPTS ITS TERMS AND CONDITIONS (UNLESS THE CUSTOMER HAS SIGNED A
SEPARATE FORMAL PURCHASE AGREEMENT WITH Cyperceptions, Inc. - DBA Probotics,
IN WHICH CASE THE SEPARATE AGREEMENT SHALL GOVERN).
Important Information About This Legal Contract
This Sale Agreement is a legal contract between the Customer and Cyperceptions
Inc., owner and operator of Probotics and aquabots.com. The Customer
accepts this Sale Agreement by making a purchase, placing an order, or
otherwise shopping on the Site. (References to "you" or "your"
shall relate to the Customer; references to "Cyperceptions"
or "Probotics" shall relate to Cyperceptions Inc., and its affiliates.)
The terms and conditions of this Sale Agreement are subject to change
without prior notice, except that the terms and conditions posted on the
Site at the time the Customer initially places or modifies an order will
govern the order in question.
This Sale Agreement constitutes the entire agreement between the Customer
and Cyperceptions relating to the purchase or sale of goods or services
on the Site. The Sale Agreement may only be modified or terminated with
regard to goods or services that have been purchased or sold on the Site
in a writing signed by Cyperceptions. Electronic records (including signatures),
that are otherwise valid, shall be accepted under the Sale Agreement.
In the event of any conflict between the terms and conditions stated
on your purchase order and this Sale Agreement or any terms and conditions
on our invoice, you agree that the provisions of this Sale Agreement and
our invoice shall control.
Cyperceptions offers a limited 14 day return policy on selected
items as described below conditional upon manufacturer acceptance. For
further information not listed, please contact a Probotics/Cyperceptions
All products returned MUST: be 100 percent complete, including
ALL original boxes and packing materials, original UPC codes on the manufacturer
boxes, manuals, blank warranty cards and other accessories and documentation
provided in the original package. We cannot accept the return of products
with severely damaged boxes.
Products that were shipped in error, or under the recommendation
of a Probotics consultant, will be gladly exchanged for a more appropriate
DEFECTIVE returns should be sent directly to the manufacturer within
30 days from the invoice date, at Probotic's and/or the manufacturers
discretion for: credit, replacement, exchange or repair.
NON-DEFECTIVE returns can be accepted directly by Cyperceptions
within 14 days from the invoice date, at Cyperceptions's discretion, for:
credit or exchange. For terms offered with a free trial period, the above
will apply with the exceptions that no restock fee will apply but the
customer will be responsible for all shipping charges related to the transaction.
Free shipping offers are voided in the event of a return and will be deducted
from the final credit amount. Satisfaction guarantees should not be confused
with free trial offers and do require a restocking fee.
Probotics strongly recommends you fully insure your return shipment
in case it is lost or damaged and you use a carrier that can provide you
with proof of delivery for your protection.
If merchandise arrives damaged: it is best to REFUSE it from the
carrier attempting delivery. If you accept the package make sure it is
noted on the carrier's delivery record in order to file a damage claim.
Save the merchandise AND the original box and packing it arrived in, notify
us immediately to arrange for a carrier inspection and a pick up of damaged
merchandise. If you do not notify us of damaged goods within the first
2 days of arrival, our regular return policy will override any claim of
damage, and will fall under all current manufacturer restrictions.
Customer is responsible for shipping charges on returned items.
Please contact us to obtain a Return Merchandise Authorization
(RMA) number before shipping your product. NO returns of any type will
be accepted without an RMA number. Any incurred shipping charges resulting
from a NON-RMA return (including delivery refusal of undamaged goods)will
be charged to the customer. For faster service, please have the following
information on hand when calling for an RMA number: customer name, invoice
number, serial number and nature of the problem.
Cyperceptions reserves the right to authorize product returns beyond
30 days from the invoice date. IF the product is accepted after 30 days,
credit will be issued toward FUTURE PURCHASES ONLY. Original shipping
charges are not refunded on returned items. Customers are responsible
for all shipping charges back to Cyperceptions on returned items.
THIS AGREEMENT AND ANY SALES HERE UNDER SHALL BE GOVERNED BY THE LAWS
OF THE STATE OF Pennsylvania, WITHOUT REGARD TO CONFLICTS OF LAWS RULES.
THE CUSTOMER CONSENTS TO THE JURISDICTION OF THE FEDERAL OR STATE COURTS
LOCATED IN MONTGOMERY COUNTY, PENNSYLVANIA FOR PURPOSES OF ANY SUIT, ACTION
OR PROCEEDING ARISING OUT OF THIS SALE AGREEMENT.
Title; Risk of Loss
Title to goods herein being purchased is retained by the seller until
goods are paid for by the purchaser and at that time title passes to the
purchaser. Loss or damage that occurs during shipping by a carrier selected
by Cyperceptions is Cyperceptions's responsibility. Loss or damage that
occurs during shipping by a carrier selected by Customer is Customer's
General Legal Disclaimer
Cyperceptions HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES EITHER EXPRESSED
OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY
OR FITNESS FOR A PARTICULAR PURPOSE. THIS DISCLAIMER BY Cyperceptions
IN NO WAY AFFECTS THE TERMS OF THE MANUFACTURER'S WARRANTY, IF ANY.

Pricing and Information Disclaimer
All pricing subject to change. For all prices, products and offers, Probotics/Cyperceptions
reserves the right to make adjustments due to changing market conditions,
product discontinuation, manufacturer price changes, errors in advertisements
and other extenuating circumstances.
While Cyperceptions uses reasonable efforts to include accurate and up-to-date
information on the Site, Cyperceptions makes no warranties or representations
as to the Site's accuracy. Cyperceptions assumes no liability or responsibility
for any errors or omissions in the content on the Site.
Limitation of Liability
Cyperceptions WILL NOT BE LIABLE FOR LOST PROFITS, LOSS OF BUSINESS OR
OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, EVEN IF ADVISED
OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY
EXCEPT AS EXPRESSLY PROVIDED HEREIN. Cyperceptions WILL NOT BE LIABLE
FOR PRODUCTS OR SERVICES NOT BEING AVAILABLE FOR USE OR FOR LOST OR CORRUPTED
DATA OR SOFTWARE. CUSTOMER AGREES THAT FOR ANY LIABILITY RELATED TO THE
PURCHASE OF PRODUCTS OR SERVICES, Cyperceptions IS NOT LIABLE OR RESPONSIBLE
FOR ANY AMOUNT OF DAMAGES ABOVE THE AGGREGATE DOLLAR AMOUNT PAID BY CUSTOMER
FOR THE PURCHASE(S) UNDER THIS AGREEMENT.
Orders; Payment Terms; Interest; Taxes
All orders will be paid in full by customer in advance of shipment by
Cyperceptions or any third party unless previous arrangements have been
approved by Cyperceptions.
Ground Shipping is defined as:
Shipping via ground transportation within the 48 continental states for
a total shipping, handling and insurance charge.
3 Day is defined as: 3-day shipping and is available on all
items for a charge.
Shipping and handling charges on all other orders vary; contact Cyperceptions
for our most current and competitive rates, options and shipping specials.
For the Customer's protection, we ship only to the verified billing address
of the Customer's credit card. Call for details.
'2 Day' is defined as: 2-day shipping and is available on all items for
'Next Day' is defined as: 1-day shipping and is available on all items
for a charge.
Shipping begins at the time of actual shipment, not at the time that the
order is placed. We make every effort to ship in-stock items on the same
day the order is received. Otherwise, in-stock items normally ship within
24 hours or on the next business day. If an item is out of stock, it will
ship as soon as it becomes available. We may also ship directly from the
manufacturer or distribution point. In this situation, tracking information
may not be supplied.
Cyperceptions will accept personal and business checks for prepay orders,
but allow 3-10 business days for clearing.
Credit Cards; Cyperceptions does not apply any surcharge for credit cards.
Credit card charges are immediately reserved and are normally submitted
for settlement within 24 hours. Cyperceptions reserves the right to charge
a customers account at the time of the purchase transaction even if the
item shipment may be delayed. Canceled orders will be credited 100% if
the request for cancellation occurs prior to shipment. If a cancellation
